1. Purpose of the Contract 

This contract governs the reservation and temporary use of the tourist apartment "Benidorm Luxury Residential" located within the Sunset Drive residential complex in Benidorm, by the guest, in accordance with the conditions detailed during the booking process.  

2. Acceptance of Conditions 

By confirming a reservation, the guest expressly accepts these terms and conditions, which will form part of the binding agreement between both parties.  

3. Reservations and Payment Terms  

• The reservation will be considered confirmed once full payment or the stipulated deposit has been received.  
• Any outstanding balance (if applicable) must be paid prior to the start of the stay.  
• The price includes use of the apartment, furnishings, facilities, standard utilities (water, electricity, air conditioning), bed linen and towels provided.  

4. Cancellation Policy 

• The applicable cancellation conditions will be those specified at the time of booking and may vary depending on the platform used (Airbnb, Booking, direct website). 
• In the event of cancellation outside the free cancellation period, the stated penalties will apply.  
• No refunds will be issued in the case of a no-show on the check-in date.  

5. Check-in and Check-out  

• Check-in: From 16:00 
• Check-out: By 11:00  
• Early check-ins or late check-outs are subject to availability and must be approved in advance.  
• Keys will be provided via a lockbox or another pre-agreed method.  

6. Guest Obligations 

• Use the property exclusively as tourist accommodation.  
• Comply with the community rules of the residential complex at all times.  
• Refrain from holding parties, events, or engaging in any activity that may disturb the peace of the neighborhood.  
• Smoking is not permitted inside the apartment.  
• Do not accommodate more guests than those specified in the reservation.  
• Immediately report any damage, defect, or issue noticed upon arrival.  
• Maintain the apartment in a reasonably clean and tidy condition.  

7. Deposit and Damages  

• A security deposit may be required in some cases. It will be refunded after verifying the good condition of the property upon guest departure.  
• The guest shall be held responsible for any damages caused by negligent or improper use of the property and its contents.  

8. Disclaimer 

The owner shall not be held liable for any loss, theft, accidents, or personal injuries incurred by the guests during their stay, except in cases provided for by law. 

9. Data Protection 

In accordance with current data protection legislation, we inform you that the personal data provided during the booking process will be treated confidentially and used solely for the purpose of managing your stay and complying with legal obligations. You may exercise your rights as provided by law.  

10. Applicable Law and Jurisdiction 

This agreement shall be governed by Spanish law. In the event of any dispute, both parties submit to the courts and tribunals of the location where the property is situated.
